Generalities

Byte-Invest NV/SA (Byte-Invest hereafter)respects the privacy of any individual, including that of the user, that of the customer on whose behalf the Application agreement was subscribed to and who is the holder and/or joint holder of the account(s) accessible and managed via Application services if applicable, and that of any other individual concerned, in accordance with the legislation in force.
The data processor for data of a personal nature about the individuals concerned is Byte-Invest NV/SA Sliksteenvest 41, B-3300 Tienen (www.byteinvest.be).

Data of a personal nature about individuals notified to Byte-Invest in the context of entering into or carrying out the Application agreement, particularly in the context of using web applications, are processed by Byte-Invest for the purposes of centralised user management, monitoring the legality of transactions and preventing irregularities.

These data are not intended to be communicated to third parties other than the people appointed by the individuals concerned, companies whose intervention is required to carry out one of the aforementioned purposes or Byte-Invest for the purposes of centralised customer management, offering and/or providing their services, customer profile and monitoring the legality of transactions (including preventing irregularities).

The individual concerned can access the data concerning him processed by Byte-Invest and, if necessary, request that incorrect data be corrected or illegally processed data be deleted.

Data of a racial or ethnic nature are never processed, unless they emerge from the data identifying the individual concerned (mainly his surname, first name, address and nationality). In this case, the individual concerned authorises the processing of these data, in accordance with Article 6 of the law of 8 December 1992 on the protection of privacy. The categories of people with access to these data are members of staff of Byte-Invest, who are responsible for carrying out transactions that can be performed via Application services, monitoring the legality of transactions and preventing irregularities, as well as handling complaints and disputes.
Similarly, neither data of a political, philosophical or religious nature, nor those relating to trade union membership or sexuality are processed, unless they appear during transactions (for example, a payment order for a contribution to a political party). Consequently, the individual concerned authorises these data to be processed in the context of carrying out transactions, in accordance with Article 6 of the law of 8 December 1992 on the protection of privacy. The categories of people with access to these data are members of staff of Byte-Invest, who are responsible for carrying out managing accounts, internal auditing, monitoring the legality of transactions and preventing irregularities, as well as handling complaints and disputes.
There is no legal provision making it compulsory to answer the questions asked by Byte-Invest, but not answering them may, depending on the circumstances, result in Byte-Invest being unable or refusing to enter into a (pre-) contractual relationship, to continue such a relationship or to carry out a transaction requested by the individual concerned.
Personal data on the individual concerned are processed by Byte-Invest in the strictest confidentiality. However, as electronic communications networks, particularly the Internet, do not offer complete security, respecting privacy can only be guaranteed if the data of a personal nature are sent via communication routes expressly indicated by Byte-Invest as being protected.

Cookie files or "cookies" can be used in some places of the Application in order to provide the user with a better service. A "cookie" is a text file containing information about the behaviour of a person visiting a web site. It is created by software on the web site server but stored on the computer hard drive of the web site visitor. During a subsequent visit to the web site, the contents of the "cookie" can be retrieved by the web site.
"Cookies" generated following the use of our services enable offers of services to be personalised according to the areas of interest of each user by identifying them through the "cookie".
These cookies contain data concerning the user such as language selected, which will avoid him having to enter these data again each time he uses our services. They record data about the services pages visited by the user and their aim is to carry out information sessions, particularly by recording the information that the user provides in the context of successive forms, in order to avoid the user receiving the same announcements repeatedly. The user data recorded by the "cookies" are also processed by Byte-Invest to draw up statistics for our services and to ensure that the contents of these services are improved.
These "cookies" are kept on the user's computer for a period of 12 months.
Most Internet navigators are automatically configured to accept "cookies". However, the user can configure his Internet navigator to inform him of each "cookie" sent or to prevent them being saved on his hard drive. However, Byte-Invest cannot guarantee the user access to our services in the event of him refusing to save cookies.

When the user visits our services, the following personal data, called "environment variables", are sent to Byte-Invest and recorded by it via the user's navigation software:
- his TCP/IP address (identification number of the user's computer on the Internet network)
- the makes and versions of his navigation software and his operating system
- the language used by the user
- all of the information about our services pages visited by the user and those of other web sites through which the user accessed our services
These data are processed by Byte-Invest so as to take into account the specific configuration of the user's computer so that he can be sent the web pages requested in the correct format. They are also processed to establish statistics for our services and to ensure that the contents of these services are improved.
